Legislative Alert: SB10-116 Change OrdersCO State Flag

For several years, ACEC/CO has been part of “Building Jobs for Colorado” (BJ4C) Coalition to address prompt pay issues.  In the past, the coalition has developed comprehensive prompt pay legislation that has been defeated in committee hearings.  This year, the coalition decided to tackle one part of two prompt pay concerns – Change Orders.  SB10-116 “Public Contracting Jobs Protection Act” sponsored by Senator Kopp and Representatives Rice and Priola requires public entities to make periodic reimbursement of a contractor’s costs, as defined in the contract, when the public entity issues a change directive without an executed change order in place, until the change order is finalized.  The goal is to increase cash flow to contractors and sub-contractors, which includes engineers, for public works projects.

SB10-116 is scheduled for the Senate Business Affairs committee Wednesday, February 17, 1:30 p.m. in the Colorado State Capitol, 3rd floor, room 354.  Please contact the Senate Business Affairs members to voice your support of SB116.
