Individual Mandate in Healthcare Law Ruled Unconstitutional
On January 31, federal district Judge Roger Vinson ruled that the individual mandate in the healthcare law is unconstitutional, therefore resulting in the entire act to be voided.
The mandate, which requires all Americans to obtain government approved health insurance, was challenged by the National Federation of Independent Business (NFIB) and 26 states. Colorado was among the 26 states that filed the lawsuit.
In a 78-page decision, Judge Vinson ruled that Congress lacks constitutional authority to force citizens to purchase health insurance.
The Justice Department, which represents the Obama administration in the Affordable Care Act, declared its intentions to appeal the ruling.
