If You Aren’t at the “Legislative”
Table, You’ll be on the Menu:
Colorado State Budget 101 and Its Impact on
Your Business:
Several years ago, ACEC/CO
past president Dave Adams urged us to get
involved in the legislative process by
saying “if we aren’t at the table, we’ll be
on the menu”. This 2009 legislative session,
ACEC/CO was at the table on transportation
funding, construction defects and other
business practices’ bills. Yet the
dominating topic at the capitol was how the
legislators were trying to eliminate a $700
million deficit to balance the state budget.
Some questioned to what extent they would go
to balanced it - by getting around the
intent of Tabor or raiding any fund that had
money in it.
On Wednesday, June
17th, 2:30 – 4:30 p.m. at ACEC/CO office
– 6th floor board room, ACEC/CO lobbyists
Bill and Lacee Artist will give an
informative presentation on “Colorado Budget
101”. They will explain:

How the state budget is
set up now

How Tabor and other
amendments, such as #23, or Arveschoug-Bird
statute impact the
state budget;

How the new SB09-228 will
change the state budget and its affects
on the state’s ability
to fund transportation, capitol
construction, water project

How much control of the
budget do the legislators have?

will give a brief explanation on Amendment
54 which affects those who have sole source
contracts and your ability to make political
contributions.

Committee Chair of the Year
Congratulations to Sally Corey of
Outsourcing Marketing for being recognized as ACEC/CO's Committee Chair of the Year. Due
to re-scheduling conflicts, Sally was not able to make
the Annual Meeting on May 8th. Instead she was given the
award by ACEC/CO President Lauren Evans and honored at
the May General Meeting.
For the past seventeen years, the council has recognized
outstanding performance by a committee chair. This year
the board singled out the Programs and Professional
Development Committee for recognition, chaired by Sally
Corey.
Three years ago, Sally suggested the “8-on-8” General
Meeting format which has proven to be very successful and has
attracted sell-out crowds to the monthly meetings. These
programs have brought many representatives from various
federal, state, and local agencies to the general
meetings, who have provided ACEC/CO members with
information on upcoming projects and how to do business
with these agencies.
Also,
Lauren Evans said at the meeting, "each president brings
their own ideas of what they would like to accomplish
during their term. It’s with the help of the committees
that our goals are accomplished. I had an idea to
institute our monthly breakfast series with speakers on
emerging markets, economic indicators and current
events. I am grateful to Sally and her committee for
embracing the Breakfast Series and arranging for very
interesting speakers."

new and retrofit projects ranging from hospitality and
higher education, to high-rises and health care.
MKK Consulting Engineers Inc. has
added Jeffrey Geiger as a designer of electrical
systems; Thomas E. Bradford, mechanical project
manager; William Faryna and Ainsley Thrailkill,
mechanical engineers; Jaxon Seekins, human
resources; and Rochelle Mellott, an electrical
designer, to the Cheyenne office.
Merrick & CO. announced that
Matt West has joined the company as director of
surveying.
Terracon’s Nate Benton and
Jared Geissler, both of the Denver office,
recently received their Leadership in Energy and
Environmental Design (LEED) Professional Accreditation.
Benton is a project manager for Terracon’s facilities
division and is responsible for the management of
property condition assessment services. He obtained his
mechanical engineering degree from the Colorado School
of Mines and joined Terracon in 2004. Geissler is an
environmental scientist supporting Terracon’s
environmental remediation group. He obtained his
chemical engineering degree from the Colorado School of
Mines and joined Terracon in 2006. Geissler is a member
of the American Institute of Chemical Engineers.
Julie
Daniel, (pictured left), Director of Business
Development, Farnsworth Group, Inc., is the
recipient of the Society of American Military Engineers
(SAME) President’s Medal. The President’s Medal was
presented to Julie on May 13, 2009, at the SAME Joint
Engineer Education and Training Conference (JETC) by the
SAME President, Rear Admiral Greg Shear, P.E., CEC, USN,
NAVFAC Commander. The SAME President’s Medal is
presented annually for outstanding leadership and
accomplishments in support of the SAME mission during
the President’s tenure.
York Engineering Services, Inc. (YES),
is pleased to announce it’s recent certification as a
DBE, M/WBE and SBE qualified firm with the City and
County of Denver. YES is also SBE certified with RTD and

General

Congressional Resolution (H.Res.
447) recognizing “ACEC’s remarkable
contributions to the industry and the Nation” on
its 100th anniversary was introduced by Rep.
Heath Shuler (D-NC) and Rep. John Boozman (R-AR)
-
Provided ACEC Minuteman Fund grant to
ACEC/Virginia and Metro Washington to help enact
limitation of liability legislation in Virginia.
Government Affairs
-
ACEC-backed legislation authorizing $38.5 billion
for water and wastewater projects over five years
and mandating use of QBS was approved by Senate
Environment and Public Works Committee.
-
Secured
increased funding and expansion of QBS in airport
improvement projects in House-passed FAA
Reauthorization legislation (H.R. 915).
-
Supported Federal
Acquisition Regulation (FAR) rule to amend
previously mandatory 10% retainage held through
construction completion, to a discretionary “up to
10 percent” retainage held only through acceptance
of design; furthermore any retainage would be based
on individual invoices rather than total contract
value.

Hosted
workshop at ACEC headquarters with FHWA and AASHTO
on procurement, oversight and audit issues and to
identify how the industry can help FHWA and the
states better manage, operate and maintain
transportation facilities and services.

ACEC-AASHTO
Audit Guide Steering Committee met at ACEC
headquarters to provide industry input, feedback and
assistance to AASHTO in revising its draft Audit and
Accounting Guide for state DOTs; a revised draft is
expected in early June for public comment, with a
final version slated for July.

ACEC-AASHTO
Joint Committee approved a statement of shared
principles for the surface transportation
reauthorization bill, including substantial funding
increases, streamlined project delivery, and
protection of states’ ability to contract with the
private sector for engineering and design services.

Delivered testimony
before the House Subcommittee on Water Resources and
Environment supporting establishment of a National
Levee Safety Program to address the deterioration of
the nation's levee systems and mitigate liability
for engineering firms.
